VOID WHERE PROHIBITED OR RESTRICTED BY LAW. COMPLETION OF AFFIDAVIT OF ELIGIBILITY / RELEASE OF LIABILITY / PRIZE ACCEPTANCE AGREEMENT MAY BE REQUIRED. ALL DISPUTES WILL BE RESOLVED SOLELY BY BINDING ARBITRATION AND PARTICIPANTS WAIVE THE ABILITY TO BRING CLAIMS IN A CLASS ACTION FORMAT.

1. Description of Promotion

Welcome to the PokerStars USA Ticket Promotion (the “Promotion”) where, each time they complete one of the Entry Methods (as defined in Section 4 below), participants earn entry tickets (“Entry/Entries”) to a random prize draw (the “Prize Draw”) for a chance to win PokerStars USA Tournament tickets (the “Prize”).

The Promotion is sponsored by TSG Interactive US Services Limited (the “Sponsor”) and carried out by PokerStars USA on X. In these Official Rules, a reference to “you” or “your” or “participant” is a reference to persons wishing to participate in the Promotion. Participation in the Promotion is expressly conditioned upon acceptance of, and compliance with all requirements set out in, these Official Rules. You may be required to sign paperwork issued by the Sponsor.

2. Promotion Period

Promotions will run on a periodic basis. Random drawing of winners will take place within a week after each competition post (the “Drawing”) and be announced via the PokerStars X channel PokerStarsUSA (@PokerStarsUSA) / X

3. Eligibility

To enter the Promotion, you must be at least 21 years of age and, be physically present in MI, NJ, or PA when you participate in the Promotion. If your social security number is associated with more than one PokerStars Account, you may only earn one Promotion Bonus via one PokerStars Account under the Promotion. Employees, officers and directors of the Sponsor, its affiliates, cable/satellite affiliates, advertising and promotion agencies, retailers, distributors, and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Promotion or receive a Promotion Bonus. Individuals who have entered any self-limited or government agency self-exclusion program or have been otherwise excluded from casinos by a government agency, the Sponsor and/or one or more of its affiliates and/or gaming license partners and persons on a Disassociated Patrons, Self-Limit, Involuntary Exclusion, Voluntary Exclusion or Self Exclusion List in jurisdictions which the Sponsor and/or its affiliates and/or gaming license partners operate are not eligible to participate in the Promotion, receive a Promotion Bonus or win the Prize.

4. How to qualify and how the Competition works

 In order to be eligible for the Competition, Entrants must:

1. have a valid @PokerStarsUSA X account which must not be set to private, deactivated, suspended, set to "Protect Your Posts" (as we will not be able to see the entry) or otherwise prevent us from viewing the account holder’s replies to our posts prior to the random prize draw taking place (as set out at paragraph 12 below);
2. within the timeframe ("Competition Period") stated in the dedicated Competition tweet ("Competition Tweet") that the Promoter posts on the PokerStarsUSA X account at twitter.com/pokerstarsUSA ("PS USA X Account"), post a reply to the Competition Tweet containing their PokerStars username and (if applicable) any hashtag that the Promoter has stated in the Competition Post must be used in the Competition entries. This is the only entry route to the Competition and entries that do not comply with the provisions of this paragraph will not be eligible. For the avoidance of doubt, any comments submitted after the Competition Period has closed will not be eligible for an entry into the random prize draw.
3. The winners will be randomly selected from the pool of eligible replies. The random draw will take place within one week of the end of the Competition Period
4. Winners will be announced by the Promoter and tagged in a Post on the PokerStarsUSA X account once they have been credited.

5. Prizes

The number of winners and the number of tickets (this can be one ticket per winner or one ticket bundle per winner) or Free Bets to be won and their value will be announced in the Competition Post.

The ticket (or ticket bundle) ("Prize(s)") or Free Bets will be credited to the winners’ PokerStars account (with the username contained in the Competition entry) within a week after the random prize draw. Tickets will expire in 1 year and Free Bets in seven days (unless stated differently in the Competition Post)

Prizes may be replaced with a substitute prize of equal or greater value, if circumstances beyond our control make it necessary to do so. All prizes are non-exchangeable, non-transferable and there are no cash alternatives. Tournament tickets can be used to register and play any tournament on the Site with buy-ins corresponding to the value of the entry. Free Bets can be used on single wagers, doubles, or any other type of accumulators. Free Bets can't be used on system bets.
By participating in the Promotion, you agree that you have reviewed and accept these Official Rules and the Sponsor’s Privacy Policy and Terms of Service (as set out in Section 6 below). You agree to abide by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects.  

Participants will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Promotion Bonus and (if applicable) the Prize, regardless of whether the Promotion Bonus and/or the Prize, in whole or in part, is used. The Promotion Bonus and (where applicable) the Prize value may be reported for tax purposes as required by law.

6. Registration Procedures

To qualify for the Promotion, regardless of the Entry Method you use, you must be physically located in the United States and be 21 or over. Creating a PokerStars Account is free, however you will be required to verify your identity and agree to the Sponsor’s Terms of Service and Privacy Policy for the relevant website. If you do not agree to the relevant website’s Terms of Service and Privacy Policy, you cannot create a PokerStars Account or participate in the Promotion.

7. Limitations on Participation

In addition to the eligibility requirements in Section 3 above, the Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in the Promotion for any reason, in its sole discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous Sponsor Promotion in good faith. The Promotion is void where prohibited by law.

14. Additional Terms

Odds: Your odds of winning the Prize depend on the number of entries in accordance with Section 4 and the number of other eligible entries awarded to other participants during the Promotion Period. Outcomes of the Prize Draw will be determined by a random number generator.

Administration: The Sponsor expressly reserves the right to amend, suspend or terminate the Promotion at any time without prior notice or consent.  Administration of the Promotion is at the sole discretion of the Sponsor.  The Sponsor reserves the right to restrict at any time any person from participating in the Promotion for any reason.  Any questions relating to eligibility, these Official Rules or any other questions concerning the Promotion will be resolved at the sole discretion of the Sponsor and its decisions will be final and binding with respect thereto.  No groups, clubs, corporations, companies, partnerships, or organizations may participate in the Promotion or reproduce or distribute any portion of these Official Rules to their members.

Tampering with Promotion: The Sponsor is not responsible for the actions of participants in connection with the Promotion, including participants’ attempts to circumvent these Official Rules or otherwise interfere with the administration, security, fairness, integrity or proper conduct of the Promotion.  Persons found tampering with or abusing any aspect of the Promotion, or whom the Sponsor believes to be causing malfunction, error, disruption or damage may be disqualified.  Additionally, any attempt to cheat the Promotion, as determined at the sole and absolute discretion of the Sponsor, may result in immediate disqualification of the relevant participant, as well as other possible consequences, including disqualification from any and all existing and future Sponsor promotions.  ANY ATTEMPT BY A PERSON TO DAMAGE ANY WEBSITE (INCLUDING ANY SOCIAL MEDIA PLATFORM OR APPLICATION) OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK ALL LEGAL AND EQUITABLE REMEDIES FROM AND AGAINST ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.  The Sponsor reserves the right, at its sole and absolute discretion, to disqualify (or terminate the Promotion Bonus or Prize of) any participant who is found to be, or suspected of, acting in violation of these Official Rules, or to be acting in an unsportsmanlike, obscene, immoral or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person.

Suspension / Modification / Termination: In the event the Sponsor is prevented from continuing with the Promotion by any event beyond its control, including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, communications or equipment failure, utility or service interruptions, riot or civil disturbance, terrorist threat or activity, war (declared or undeclared), interference with the Promotion by any party, or any federal, state, local or provincial government law, order, or regulation, order of any court or jurisdiction, or other cause not reasonably within the Sponsor’s control, the Sponsor shall have the right to modify, suspend or terminate the Promotion. The Sponsor additionally reserves the right, in its sole and absolute discretion: (a) to modify, suspend or terminate the Promotion should causes beyond the Sponsor’s control corrupt or interfere with the administration, integrity, operation, security or proper play of the Promotion; or (b) to disqualify any participant found to be, or suspected of: (i) tampering with the entry process or the operation of the Promotion; (ii) acting in violation of these Official Rules; or (iii) acting in an un-sportsmanlike manner.

Release and Waiver of Liability:  By participating in the Promotion, you agree to release, discharge, indemnify and hold harmless the Sponsor and its directors, officers, employees, agents, successors and assigns (collectively, “Released Parties”) from and against any and all claims, liability, costs (including attorneys’ fees), losses, damages, fines or injuries (up to and including bodily injury and death) of any kind arising out of or related to: (i) your participation in the Promotion (including travel to/from any Promotion and/or Prize activity); (ii) any acceptance, possession, misuse or use of the Promotion Bonus and/or Prize (including, without limitation, losses, damages or injuries to your or any other person’s equipment or other property, or to your/their persons, including those arising from any travel to/from any Prize event or activity); (iii) the Released Parties’ violation of rights of publicity or privacy, claims of defamation or portrayal in a false light or based on any claim of infringement of intellectual property; and (iv) any typographical, human or other error in the printing, offering, selection, operation or announcement of any Promotion activity and/or Prize.  Without limiting the generality of the foregoing, you agree that the Released Parties have neither made nor will be in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, in connection with the Promotion and/or with respect to the Prize, including, without limitation, to the Prize’s quality or fitness for a particular purpose. You agree and that the Released Parties shall have no responsibility or liability for discontinued prizes; human error; incorrect or inaccurate transcription of registration and/or account information; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or Internet service provider utilized by the Sponsor interruption or inability to access the website, application or any online service via the Internet due to hardware or software compatibility problems; any damage to your (or any third person’s) computer and/or its contents related to or resulting from any part of the Promotion; any lost/delayed data transmissions, omissions, interruptions, viruses, bugs, defects; and/or any other errors or malfunctions, even if caused by the negligence of the Released Parties. You further agree to indemnify and hold harmless the Released Parties from and against any and all liability resulting or arising from the Promotion and to release all rights to bring any claim, action or proceeding against the Released Parties and hereby acknowledge that the Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the Prize, including express warranties provided exclusively by a supplier that may be sent along with the Prize. The Released Parties are not responsible for any changes or unavailability of the social media platform used for purposes of administering the Promotion that may interfere with the Promotion (including any limitations, any restrictions, or any conditions on the Sponsor’s ability to use the social media platform for the Promotion as set forth herein that are not acceptable to the Sponsor) or your ability to timely enter, receive notices or communicate with the Sponsor via the social media platform, in which case the Sponsor, in its sole discretion, may terminate or modify the Promotion.

Entry Information and Promotion Communications: As a condition of entering the Promotion, you give consent for the Sponsor to obtain and deliver your name, address and other information to third parties for the purpose of administering the Promotion and to comply with applicable laws, regulations and rules.  Any information you provide to the Sponsor may be used to communicate with you in relation to the Promotion and may be used on the Promotion winners’ list.

Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules or the rights and obligations of participants, the Sponsor and/or the Released Parties in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of Florida, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.

BY ENTERING THE PROMOTION, YOU AGREE THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (A) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE PROMOTION, OR ANY PRIZE AWARDED, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (B) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS WILL BE LIMITED TO ACTUAL THIRD-PARTY, OUT-OF-POCKET COSTS INCURRED (IF ANY) NOT TO EXCEED US$10.00, BUT IN NO EVENT WILL ATTORNEYS’ FEES BE AWARDED OR RECOVERABLE; AND (C) UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN ANY AWARD FOR, AND YOU HEREBY KNOWINGLY AND EXPRESSLY WAIVE ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, LOST PROFITS AND/OR ANY OTHER DAMAGES, OTHER THAN ACTUAL OUT OF POCKET EXPENSES NOT TO EXCEED US$10.00, AND/OR ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

Miscellaneous:  The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of these Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. The Sponsor’s failure to enforce any provision of these Official Rules will not constitute a waiver of that provision. You agree to waive any rights to claim ambiguity of these Official Rules.  Headings are solely for convenience of reference and will not be deemed to affect in any manner the meaning or intent of any provision hereof.  In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Promotion-related materials, Privacy Policy or Terms of Service on any website, social media platform or application and/or these Official Rules, these Official Rules shall prevail, govern and control and the discrepancy will be resolved in the Sponsor’s sole and absolute discretion.
