- Description of Promotion
Welcome to the Fall Challenge promotion (the “Promotion”), where, subject to these Terms and Conditions, eligible participants who satisfy the Promotion Requirements (as defined in Section 4 below) will have a chance to receive a Promotion Bonus depending on their final leaderboard position (as defined in Section 5 below).
The Promotion is sponsored by TSG Interactive US Services Limited (the “Sponsor”). In these Terms and Conditions, a reference to “you”, “your” or “participant(s)” is a reference to persons wishing to participate in the Promotion. Participation in the Promotion and redemption of the Promotion Bonus is expressly conditioned upon your acceptance of, and compliance with all requirements set out in, these Terms and Conditions. You may be required to sign paperwork issued by the Sponsor.
- Promotion Period
The Promotion will begin at 8:00 AM ET on November 17, 2023 and end at 11:59 PM ET on November 23, 2023 (the “Promotion Period”).
- Eligibility
To enter the Promotion, you must be at least 21 years of age, be physically present in New Jersey, Pennsylvania or Michigan when you participate in the Promotion (depending on whether you are playing on the www.pokerstarsnj.com, pokerstarsmtairycasino.com or www.pokerstarsmi.com website respectively), and have received an invitation from the Sponsor. The invitation is non-transferable and if you are not directly invited by the Sponsor, you will not be eligible to participate in the Promotion. If your social security number is associated with more than one PokerStars Account, you may only earn one Promotion Bonus via one PokerStars Account under the Promotion. Employees, officers and directors of the Sponsor, its affiliates, cable/satellite affiliates, advertising and promotion agencies, retailers, distributors, and each of such employees’, officers’ and directors’ immediate family members and/or those living in the same household (whether legally related or not) of each are not eligible to participate in the Promotion or receive a Promotion Bonus. Individuals who have entered any self-limited or government agency self-exclusion program or have been otherwise excluded from casinos by a government agency, the Sponsor and/or one or more of its affiliates and/or gaming license partners and persons on a Disassociated Patrons, Self-Limit, Involuntary Exclusion, Voluntary Exclusion or Self Exclusion List in jurisdictions in which the Sponsor and/or its affiliates and/or gaming license partners operate are not eligible to participate in the Promotion or receive a Promotion Bonus.
- Action Required
To participate in the Promotion, during the Promotion Period you must log into your PokerStars Account, opt-in to the Promotion via the Promotion invitation displayed in the “Challenges” section of your PokerStars Account (the “Invitation”) and complete at least 1 challenge to receive leaderboard points (the “Promotion Requirements”). Challenges as follows:

Upon satisfying the Promotion Requirements, the top 100 players on the leaderboard will receive the following:

Cash or casino bonus will be credited via chest to your TSG Account (as defined below) within seventy-two (72) hours after the promotion period ends. Chests will expire on November 27, 2023 at 10:00 ET.
The winner of the golf trip to Vegas with be notified within seventy-two (72) hours after the promotion period ends via the contact information they provided when they submitted their Entry.
In an event of a tie, the player who reaches the top points first will be the winner.
Participants will be solely responsible for all federal, state, and local taxes, and for any other fees or costs associated with the Promotion Bonus received, regardless of whether the Promotion Bonus, in whole or in part, is used. The Promotion Bonus value may be reported for tax purposes as required by law.
For new Jersey and Michigan, The Competitor Pool will consist of participants participating via the pokerstarsnj.com and pokerstarsmi.com website collectively. The Competitor Pool for Pennsylvania will consist of participants participating via the pokerstarsmtairycasino.com website only. - Registration Procedures
To qualify for the Promotion, you must have an active real money verified account on pokerstarsnj.com, pokerstarsmi.com, or pokerstarsmtairycasino.com (“PokerStars Account”). Creating a PokerStars Account is free, however you will be required to verify your identity and agree to the Sponsor’s Terms of Service and Privacy Policy for the relevant website. If you do not agree to the relevant website’s Terms of Service and Privacy Policy, you cannot create a PokerStars Account or participate in the Promotion.

- Limitations on Participation
In addition to the eligibility requirements in Section 3, the Sponsor reserves the right to refuse or otherwise restrict your eligibility to participate in the Promotion for any reason, in our sole discretion, including based on your wagering patterns or wagering history or if you failed to take advantage of any previous Sponsor promotion in good faith. The Promotion is void where prohibited by law. Limit of 1x Promotion Bonus per PokerStars Account holder.
- Wagering Requirements
See Section 4 for the wagering requirements that apply to the redemption of the Promotion Bonus. Any wager placed by you using site credits or bonuses received from a separate Sponsor promotion will not be capable of qualifying as an Eligible Wager. Any wager placed by you prior to you opting in to the Promotion or after the expiration of Promotion Period will not be capable of qualifying as an Eligible Wager.
The Casino Credit may only be used for wagering on your PokerStars Account. To convert the Casino Credit to cash, you must earn 2 redemption points for every US$1.00 of the Casino Credit wagered on any of the table or slot casino games available on the PokerStars casino site (depending on whether you are playing on the www.pokerstarsnj.com, pokerstarsmtairycasino.com or www.pokerstarsmi.com website respectively). Redemption points are earned based on the game type and amount wagered. - Order of Funds Used for Wagering
Bonus spins and poker tickets are used before deposited funds when wagering.
- Eligible Games
Casino Site Credit may be used on all Sponsor’s table and slot casino games except Craps.
Bonus spins may be used on the following games (where applicable): Stars Invaders Classic, Diamond Stars Classic, Pharaoh's Loot Classic, Frog of Fortune, Tomb of Ra Classic, Aztec Explorer, Stars Classic, Wilbur's Wild Wonder Land.
- Restrictions on Withdrawal
See Section 8 for instructions on how to withdraw winnings from wagers placed using the Promotion Bonus. The Promotion Bonus is not transferable and cannot be substituted except in the Sponsor’s sole discretion. Any unused portion of the Promotion Bonus will be automatically withdrawn from your PokerStars Account 7 days after it is credited to your PokerStars Account. You may withdraw your deposited funds without penalty at any time.
- Cancellation
Should you wish to cancel your participation in the Promotion at any time, please contact customer support at support@starssupportnj.com (for New Jersey participants), support@starssupportpa.com (for Pennsylvania participants) or support@starssupportmi.com (for Michigan participants). Upon cancellation, you may withdraw any funds you have deposited into your PokerStars Account without restriction. However, any Casino Credit or Promotion Bonus amount in your PokerStars Account cannot be withdrawn.

- Additional Terms
Odds: The odds of winning the prize available to be won in the Prize Draw will depend on the number of eligible entries received by the Sponsor during the Promotion Period. Outcomes of the Prize Draw will be determined by a random number generator.
Administration: The Sponsor expressly reserves the right to amend, suspend or terminate the Promotion at any time without prior notice or consent. Administration of the Promotion is at the sole discretion of the Sponsor. Sponsor reserves the right to restrict at any time any PokerStars Account holder from participating in the Promotion for any reason. Any questions relating to eligibility, these Terms and Conditions or any other questions concerning the Promotion will be resolved at the sole discretion of the Sponsor and its decisions will be final and binding with respect thereto. No groups, clubs, corporations, companies, partnerships, or organizations may participate in the Promotion or reproduce or distribute any portion of these Terms and Conditions to their members.
Release and Waiver of Liability: By redeeming the Promotion, participants agree to release, defend, indemnify and hold harmless the Sponsor, its affiliates, gaming license partners, advertising and promotion agencies, directors, officers, employees, representatives and agents from and against any and all liability claims or actions of any kind whatsoever (however named or described) for injuries, death, damages or losses to persons and property which may be sustained in connection with: (i) your participation in the Promotion; and (ii) the receipt, use or misuse of the Promotion Bonus, or while preparing for, participating in, and/or traveling to any Promotion-related activity, including those damages caused by the Sponsor’s own negligence. The Sponsor expressly disclaims any responsibility or liability for injury or loss to any person or property relating to the delivery and/or subsequent use or misuse of the Promotion Bonus. In consideration of the Promotion Bonus, each individual hereby agrees and consents, without further authorization, compensation or remuneration of any kind, to the use of such individual’s name, photograph, likeness (including his/her voice), biographical information and statements concerning the Promotion, in any and all advertising, promotions and other publicity conducted by the Sponsor and its affiliates.
Governing Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions or the rights and obligations of participants and the Sponsor in connection with the Promotion will be governed by and construed in accordance with the internal laws of the State of New York, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other laws.
Dispute Resolution: The parties each agree to finally settle all disputes only through arbitration; provided, however, the Sponsor shall be entitled to seek injunctive or equitable relief in the state and federal courts in New York County, New York and any other court with jurisdiction over the parties. In arbitration, there is no judge or jury and review is limited. The arbitrator’s decision and award is final and binding, with limited exceptions, and judgment on the award may be entered in any court with jurisdiction. The parties agree that, except as set forth above, any claim, suit, action or proceeding arising out of or relating to the Promotion shall be resolved solely by binding arbitration before a sole arbitrator under the streamlined Arbitration Rules Procedures of JAMS Inc. (“JAMS”) or any successor to JAMS. In the event JAMS is unwilling or unable to set a hearing date within fourteen (14) days of the filing of a “Demand for Arbitration”, then either party can elect to have the arbitration administered by the American Arbitration Association (“AAA”) or any other mutually agreeable arbitration administration service. If an in-person hearing is required, then it will take place in New York, New York. The federal or state law that applies to these Terms and Conditions will also apply during the arbitration. Disputes will be arbitrated only on an individual basis and will not be consolidated with any other proceedings that involve any claims or controversy of another party, including any class actions; provided, however, if for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then the agreement to arbitrate doesn’t apply and the dispute must be brought in a court of competent jurisdiction in New York County, New York. The Sponsor agrees to pay the administrative and arbitrator’s fees in order to conduct the arbitration (but specifically excluding any travel or other costs of participant to attend the arbitration hearing). Either party may, notwithstanding this provision, bring qualifying claims in small claims court.
LIMITATION OF LIABILITY: TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE SPONSOR SHALL NOT BE RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, ECONOMIC, EXEMPLARY, PUNITIVE OR OTHER DAMAGES UNDER ANY CONTRACT, NEGLIGENCE, STRICT LIABILITY OR OTHER THEORY ARISING OUT OF OR RELATING IN ANY WAY, DIRECTLY OR INDIRECTLY, TO REDEMPTION OF THE PROMOTION, EVEN IF FORESEEABLE OR EVEN IF THE SPONSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Miscellaneous: No waiver of any of the provisions of these Terms and Conditions shall be deemed or shall constitute a waiver of any other provisions hereof, nor shall waiver constitute a continuing waiver unless otherwise expressly provided. If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of these Terms and Conditions, which will otherwise remain in full force and effect.
